§ 2. Definitions

• Customer – a natural person, legal person or organisational unit placing an order.
• Consumer – a natural person concluding a contract not directly related to their business activity.
• Product – a composite, carbon fiber or fibreglass part offered in the Store.
• Made-to-order Product – a Product made according to a configuration or specification indicated by the Customer.

§ 3. Nature of the products

1. The Products are made by hand in Poland, in prepreg technology or by hand lamination.
2. Because of the manual nature of production, slight differences in the weave pattern, shade and depth of finish are acceptable. These differences do not constitute a defect of the Product.
3. Most Products are made to order after the Customer places the order.

§ 4. Placing orders

1. Orders can be placed through the Store 24 hours a day.
2. Placing an order requires providing the data needed to fulfil it and accepting these Terms.
3. The contract is concluded when the Seller confirms acceptance of the order.
4. The Customer receives confirmation of the contract terms on a durable medium.

§ 5. Prices and payments

1. Prices in the Store are gross prices in Polish zloty.
2. Delivery costs are given before the order is placed.
3. The available payment methods are presented in the order summary.
4. For made-to-order Products the Seller may require an advance payment.

§ 6. Fulfilment and delivery

1. The lead time is given with the Product or in the order confirmation and counts from the booking of the payment or advance.
2. Delivery is carried out by courier companies.
3. We recommend checking the parcel in the presence of the courier and drawing up a damage report if it is damaged.

§ 7. Right of withdrawal

1. A Consumer may withdraw from the contract within 14 days of receiving the Product by submitting a statement.
2. The right of withdrawal does not apply to non-prefabricated Products made to the Consumer’s specification or serving their individual needs – this covers made-to-order Products, including the chosen finish, pigment and Custom projects.
3. Information about the absence of the right of withdrawal is presented before the order is placed.
4. The right of withdrawal also expires once permanent work on the Product has started, including drilling, cutting, sanding, bonding or painting.

§ 8. Complaints

1. The Seller is liable for the conformity of the Product with the contract under the applicable provisions.
2. A complaint should be sent to [email protected] with the order number, a description and photo documentation.
3. The Seller handles a complaint within 14 days.
4. Complaints about fit are not accepted once permanent work on the Product has started – a trial fitting is mandatory before installation.

§ 9. Fitting and safety

1. A fitting kit is supplied with every Product.
2. Fitting in an authorised workshop or by a HELK DESIGN partner is recommended.
3. The Customer is required to read the Trial fitting, installation and safety instructions before starting work.

§ 10. Out-of-court dispute resolution

A Consumer may use out-of-court ways of handling complaints and pursuing claims, including mediation at the Voivodeship Inspectorates of Trade Inspection and the ODR platform.

§ 11. Personal data

The rules for processing personal data are set out in the Privacy and cookies policy.

§ 12. Final provisions

1. Matters not covered here are governed by Polish law.
2. The Seller may amend these Terms for important reasons; an amendment does not affect orders placed before it comes into force.
